TERMS & CONDITIONS OF SKILL TREE

I. GENERAL PROVISIONS

These Terms & Conditions (hereinafter "T&C") regulate the relationship between Skill Tree Ltd. / Скилтри OOД (hereinafter "Company") and all users (hereinafter "Client" or "Consumer").

By accessing the website www.skilltree.bg, or making an order, or joining an event, the Consumer accepts these Terms & Conditions. They form an integral part of every contract for sale or provision of services.

III. SCOPE OF TERMS & CONDITIONS

The Company provides:​

  • Organizational services

  • Skill-development services 

  • Custom art services & goods

  • Online sale of physical goods 

IV. PRICES AND PAYMENT

4.1. Price Display

  • All prices are displayed in both Bulgarian Leva (BGN) and Euro (EUR) in accordance with Bulgarian Law on Introduction of Euro

  • Fixed exchange rate: 1 EUR = 1.95583 BGN

  • Prices are in BGN/EUR and include VAT

  • Prices are displayed on the product or in the service description

  • The price is final and includes all charges except shipping costs.

  • Price labels show both currencies clearly and legibly in the same font size

4.2. Payment Methods
Accepted payment methods:

  • Cash on Delivery (COD) via courier

  • Credit/Debit Card (via MyPOS secure payment terminal)

  • Bank Transfer

  • Invoices

  • Online payment platforms (if available)

4.3. Deposits

  • For pre-orders (custom-made items): 50% advance payment required before work begins

  • For workshops: Full payment required upon booking

  • For consulting services: Advance payment or payment by agreement

4.4. Payment Security

  • Card payments are processed through MyPOS secure payment system

  • The Company does not store customer card data

  • Transaction security is guaranteed by MyPOS

  • The Company is not responsible for technical failures or security breaches by MyPOS

V. SERVICES & ORDER

5.1. Order or Service Conclusion

  • Order or services are concluded upon their delivery and when the agreed payments are confirmed

5.2. Order Information

  • Client must provide accurate contact information with each order

  • The Company is not responsible for delivery to incorrect addresses provided by the Client

5.3. Pre-orders

  • For custom-made items (Custom Art), written confirmation from Client via email is required

  • 50% advance payment is mandatory before work begins

  • Final price is provided before work commences

VI. DELIVERY

6.1. Delivery Method

  • Deliveries are made via courier services (Econt, Speedy, and others) in Bulgaria and the EU

  • The Company reserves the right to change couriers without prior notice

  • For international delivery, Client bears all additional charges

6.2. Delivery Timeframes

  • Delivery timeframes depend on product availability and recipient address

  • Standard delivery is within 2-5 working days in Bulgaria

  • For pre-orders, timeframe is specified in the offer and is not binding in case of force majeure

6.3. Shipping Costs

  • Shipping costs are calculated at checkout and paid by Client

  • Exception: Return shipping is covered by the Company

  • For refunds, return shipping is paid by Client (if applicable)

6.4. Risk Transfer

  • Risk of goods transfers to Client or the delivery provider upon receipt

  • In case of damage or loss upon receipt, Client must notify courier immediately

VII. RIGHT TO WITHDRAW AND RETURNS

7.1. Right to Withdraw for Products

  • Consumer has the right to cancel the contract and return received goods within 14 calendar days of receipt without providing reason

  • Cancellation must be submitted in writing to: skilltree.yv@gmail.com

7.2. Conditions for Valid Product Return

  • Goods must be in original condition and packaging

  • Product must be unused

  • All documents and accessories must be included

  • Proof of purchase (receipt, order number) required

7.3. Return Procedure

  • Client must notify Company in writing

  • Return shipping costs are paid by Client

  • Upon receipt of returned goods (within 7 days), Company verifies condition

  • Refund is made via bank transfer within 14 days of receipt

7.4. Exceptions from Right to Withdraw

Right to withdraw does NOT apply to:

  • Items custom-made to Client specifications (Custom Art) as per Consumer Protection Act Section 57, Par. 1, Item 3

  • Organizational services (workshops, courses) after participation confirmation

  • Consulting services after provision

Advance payments for pre-orders are NOT refundable if Client withdraws after work has commenced.

VIII. WORKSHOPS AND COURSES

8.1. Booking

  • Booking is confirmed upon payment and Company confirmation

  • Client must arrive on time

  • Children below 13 years of age need a guardian to accompany them

8.2. Workshop Cancellation

  • Cancellation more than 48 hours before start: 100% refund minus 10% administrative fee

  • Cancellation within 12-48 hours: 50% refund minus 10% administrative fee

  • Cancellation within 12 hours or No-Show: Payment is NOT refundable

8.3. Cancellation by Company

  • The Company may cancel the workshop or event if the minimum participant requirement of 5 people is not met or as otherwise specified

  • In case of cancellation by Company, payment will be refunded or alternative time offered

8.4. Workshop Conduct Rules

  • The Client is expected to conduct oneself in a reasonable manner and in accordance with our rules and regulations

  • Participants must follow the provided instructions. The Client takes responsibility for any misconduct.

  • If we, in our sole and absolute discretion, consider that the Client has behaved in an unacceptable manner, then the Company reserves the right to require the Client to leave the course/event immediately.

  • For the benefit of all, and to comply with legislation, the event locations are a non-smoking area. 

  • No food or beverages allowed in workshop area.

  • Participants must wear appropriate clothing

  • Equipment use without supervision is prohibited

8.5. Liability

  • The Company is NOT responsible for participants' personal belongings

  • Participants assume risk when using equipment

  • Participant is fully responsible for any damage caused

IX. CUSTOM ART SERVICES

9.1. Order

  • The Client provides a detailed description of the desired item

  • The Company provides a quote with price and timeline

9.2. Advance Payment

  • Advance payment is 50% of the total price

  • Remaining 50% is due upon completion and before delivery

9.3. Production Process (also applicable to workshop creations)

  • Company works according to agreed specifications

  • Minor creative variations (color nuances, slight differences in handmade items) are NOT considered defects

9.4. Changes 

  • Client may request changes only before the main production begins

  • Changes after work has started may incur additional costs

9.5. Storage and Delivery 

  • Upon completion, Company sends photos for approval

  • Delivery is made as agreed 

  • If the item is not collected within 30 days of completion, the Company bears no responsibility for the item (also applicable to workshop creations)

9.6. No Right to Withdraw

  • Client has NO right to withdraw after work has begun

  • Advance payment is NOT refundable if Client withdraws

X. SKILL-DEVELOPMENT SERVICES

10.1. Booking

  • Skill-development services are booked by prior arrangement via email or phone

  • Full payment is due before the consultation or as agreed

10.2. Skill-development services cancellation

  • If Client cancels a scheduled service, full refund is provided minus 10% administrative fee

  • No-Show: Payment is NOT refundable

10.3. Refunds

  • All refunds are made via bank transfer within 14 days

XI. COMPLAINTS AND WARRANTIES

11.1. Legal Warranty

  • All goods come with two-year legal warranty for conformity with sales contract per Consumer Protection Act

11.2. Warranty Coverage

  • Warranty does NOT apply to defects arising from:

    • Normal wear and tear

    • Misuse

    • Improper storage

    • Third-party interference

11.3. How to File Complaint

  • Complaints accepted via email: skilltree.yv@gmail.com

  • Product complaints: Within 7 days of receipt

  • Service complaints: Within 7 days of service provision

  • Client must provide proof (photos, video)

11.4. Complaint Resolution

  • Company investigates complaint within 8 working days

  • If complaint is upheld:

    • Product replacement, or

    • Full refund

  • If complaint is rejected, Company provides written explanation

XII. INTELLECTUAL PROPERTY
  • All text, images, logos, graphics, and other content on www.skilltree.bg are property of Skill Tree Ltd.

  • Copying, reproduction, and distribution without written permission is prohibited

  • Client has the right to use purchased goods for personal use only, unless otherwise agreed

XIII. DATA PROTECTION
  • When placing an order, The Company processes Client's personal data

  • Processing is done in accordance with Regulation (EU) 2016/679 (GDPR)

  • For more information, see Privacy Policy: www.skilltree.bg/privacy-policy

  • By placing an order or attending an event, Client consents to personal data processing

XIV. LIABILITY AND FORCE MAJEURE

14.1. Company Liability

  • Company is NOT responsible for:

    • Temporary website unavailability

    • Delivery delays due to circumstances beyond the Company's control

    • Damage from misuse of the product

    • Indirect or unforeseen damages

    • Loss of revenue or data

14.2. Maximum Liability

  • Company's maximum liability is limited to the order value

14.3. Force Majeure

  • In case of force majeure (war, natural disasters, epidemics, government decisions):

    • Delivery timeframes may be extended

    • Company may cancel orders

    • Client receives full refund of payment

XV. DISPUTE RESOLUTION

15.1. Applicable Law

  • These Terms & Conditions are governed by the laws of the Republic of Bulgaria

  • The following laws apply:

    • Consumer Protection Act (ЗЗП)

    • Electronic Commerce Act

    • Law on Supply of Digital Content and Digital Services and Sale of Goods (OGZPP)

    • Regulation (EU) 2016/679 (GDPR)

    • Commercial Law

15.2. Dispute Resolution

  • All disputes are resolved by mutual agreement

  • If settlement cannot be reached, disputes are referred to competent court in Razgrad, Bulgaria

  • For consumer disputes, Client may contact the Commission for Consumer Protection

15.3. Consumer Complaints

  • Consumer has right to file complaint with Commission for Consumer Protection

XVI. COOKIES AND TRACKING DATA
XVII. MODIFICATIONS TO TERMS & CONDITIONS
  • The Company may update these Terms & Conditions at any time

  • Changes are published on the website and take effect from the publication date

  • Continued use of services means acceptance of changes

  • For substantial changes, Client will be notified via email

XVIII. MANDATORY INFORMATION FOR CONSUMERS

In accordance with the Bulgarian Electronic Commerce Act and the Consumer Protection Act, the following mandatory information is provided:

18.1. Business Information

  • Legal business name, registration number, and VAT number are displayed in Section II

  • Physical address and contact details are provided in Section II

  • The Company operates under the laws of Republic of Bulgaria

18.2. Technical Support

18.3. Order Confirmation

  • All orders are confirmed via email

  • Client receives a confirmation number for tracking in the case of delivery via service

  • Confirmation constitutes acceptance of this contract

18.4. Statutory and Commercial Guarantees

  • All goods are supplied with a statutory 2-year warranty as per the Consumer Protection Act

  • Additional commercial guarantees (if any) are explicitly stated in the product description

  • Warranty does not exclude consumer statutory rights

18.5. Out-of-Court Dispute Resolution

  • For disputes with the Company, Client may use out-of-court dispute resolution through the Commission for Consumer Protection

18.6. NRA Registration

  • This Company is registered with the Bulgarian National Revenue Agency (NRA) as an online trader

  • The Company maintains sales records in accordance with Ordinance No. H-18
